Terms and Conditions
1 – Quotation
A quotation is prepared for each assignment, clearly describing the assignment. It also specifies how, when, and with whom the assignment will be carried out. Where applicable, the quoted amount will be specified and explained as fully as possible.
Quotations are non-binding, valid for one month, and are for estimation purposes only. Because processing times cannot be estimated, a quoted amount is never binding unless explicitly stated. There are no costs associated with the quotation itself.
If a client accepts a quotation, they must confirm the assignment by replying to the email containing the quotation offer. By accepting the quotation, the client also agrees to these general terms and conditions.
If the quotation contains conditions other than those included in these general terms and conditions, the relevant conditions as contained in these general terms and conditions will no longer apply.
2 – Additional Work
If an assignment changes in such a way that it exceeds the work described in the quotation, this constitutes additional work. Charges may be incurred for this. Should this situation arise, Gijs Vervenne will inform the client in a timely manner.
In the event of additional revisions beyond the number of free revisions stated in the quote, a fee of 150% of the hourly rate (being the daily rate divided by 8) will be charged.
3 – Cancellation
Cancellation of an assignment within 24 hours prior to the work will be charged at a rate of 100% of the quoted labor costs and 50% of the equipment costs. Cancellation of an assignment within 48 hours prior to the work will be charged at a rate of 50% of the quoted labor costs and 25% of the equipment costs. Cancellation costs for materials, equipment, freelancers, and services hired by Gijs Vervenne will be fully charged to the client in accordance with the terms and conditions of the relevant party.
No fee will be charged for written cancellations of assignments. If work has already been carried out (such as preparations, execution, or any reservations related to the assignment), Gijs Vervenne will charge a fee based on the costs and/or hours already spent.
4 – Contact Person
For each assignment, the client designates one contact person. All communication between Gijs Vervenne and the client will be handled by this person. The contact person is responsible for acting on behalf of the client.
5 – Travel and Accommodation Expenses
The travel allowance is €0.30 per kilometer traveled, unless otherwise agreed upon and agreed upon in the quote. For journeys longer than one hour, an additional travel allowance may be charged.
The travel expenses stated in the quote are indicative. Actual travel expenses will be charged upon invoicing.
6 – Music Rights
If copyrighted music is used, music rights must be paid to the Buma Stemra Foundation. Gijs Vervenne can provide an estimate of the costs. These costs are included in the quote but may be higher or lower on the final invoice. This is due to the complex fees of the BUMA/STEMRA foundation.
Please note that music rights can be time-bound and limited in the number of views. Therefore, after a certain period or a certain number of views, the music may no longer be used.
It is also possible to purchase royalty-free music. This covers all music rights for unlimited use with a clear, one-time fee.
Gijs Vervenne will reject any request for illegal use of music.
7 – Copyright
All text, sound, and images produced by Gijs Vervenne (concepts, scripts, screenplays, videos, photos, animations, etc.) are copyrighted and protected. Permission must be granted by the author for the use of copyrighted material.
8 – Intellectual Property
Workflow, templates, designs, forms, setups, camera settings, and editing documents are the intellectual property of Gijs Vervenne and are not made available.
9 – Copyright
A client receives the copyright to the video production they order, for the purpose specified in the quote. Should a client wish to extend the copyright or make physical copies, this will be done in consultation with Gijs Vervenne. This also applies to any third-party rights to the use of music and images.
In the event of copyright infringement, Gijs Vervenne is not responsible for any claims from third parties.
10 – Camera Material (Raw Material, Footage)
Unless otherwise agreed, camera material is not made available without further ado. The copyright to the camera material
